Abstract

With the assumption of the prince’s title, the monarchs of Beneventum arrogate themselves the right to ratify some new laws keeping out the Edict. The legal assumption is the claim of a leader role towards Lombard people: in open conflict with Charlemagne, Arechi II considers himself the only lawful continuer of the code. In dialectic relationship with the previous dispositions, Beneventan laws integrate that normative patrimony revealing some totally Early Middle Ages’ characteristic and a sure knowledge of the political ideas theorized by the cultured clergy. Although they show some elements of unquestionable originality, they put themselves at the first place like political operation, directed towards reaffirmation their independence from the Reign of Papia on the juridical plan too.
