The paper is focused on some aspects of P2P and software agents in order to have a discussion on legal issues. In particular the analysis of of the functionality and the capability of the mentioned technologies, to understand if they are able to guarantee a high level of protection of the right involved in the use of P2P through agents and, at the same time, to maintain freedom in open network.
