The article presents the international normative framework for geographical indications that includes the case of homonymy. In the case of Rioja wine, and at the time of the TRIPS Agreement, this problem was discussed in relation to the production of wines in the province of La Rioja Argentina. In 2003, this author addressed the issue and, subsequently, the Rioja Qualified Origin Regulatory Board presented a first administrative and judicial case later in Argentina. This article gives an account of the case and how the Argentine Justice resolved the issue.
