The essay investigates how parents’ choices in directing their children towards religion may affect the harmonious growth of the minor. It purports the idea that such choices are subject to a first limitation, of a negative nature, which is a prohibition to expose the minor to a material or moral prejudice, and a second limitation, of a positive nature, which is the obligation to direct the inclination of the child, until the child reaches full capacity of comprehension. In light of these considerations, it analyzes the legal relevance of the agreements between the parents on religious education and the conflicts that may arise in the event that the religious freedoms of the two parents are themselves at odds, because of a diversity of opinion which was latent up to that moment or the conversion of one parent to a new religion. The conflict may emerge when the relationship of the parents is still alive or during a crisis that has led to separation or dissolution of the relationship. In this second case, the conflict can become decisive for the decisions concerning the custody of the child or the arrangement of the child with one or the other parent or the conditions for the right to visit.
