The essay begins by pointing out the effects of the European directives no. 2009/38 on the field of companies' restructuring processes. It goes on analysing one kind of transnational collective agreement related to this field and stressing the diversity among the subscribers: European Works Councils, international and national Trade Unions. This is the starting point for a study on the potential legal effects of the collective agreements. The authors show the difficulties strictly related both to the binding effect of the agreements and to their transnational sphere of application.
