Following a brief introduction to the regulation of artificial intelligence according to the European Union (‘AI Act’) and a review of the substance of the subsidiarity principle, including its historical and cultural origins, the Author examines how this very paradigm has been incorporated into the AI Act. The analysis subsequently focuses on the concept of ‘data’ and the relationship between the individual and the challenges posed by technological evolution. In the final part of the Article, the Author attempts to identify the subsidiarity paradigm in the context of the innovative use of the regulatory framework.
