Following a brief introduction to the regulation of artificial intel- ligence according to the European Union (‘AI Act’) and a review of the substance of the subsidiarity principle, including its historical and cultural origins, the Author examines how this very paradigm has been incorporated into the AI Act. The analysis subsequently fo- cuses on the concept of ‘data’ and the relationship between the indi- vidual and the challenges posed by technological evolution. In the fi- nal part of the Article, the Author attempts to identify the subsid- iarity paradigm in the context of the innovative use of the regulato- ry framework.
