The recent EU reform on geographical indications introduces, among other innovations, a special discipline for the use of PDOs and PGIs in the trade name and presentation of “derivative” products, i.e. those that use as an ingredient or component the certified typical product referred to. The new regulatory framework is important because it fills a previous EU normative gap, which had given rise to different national legislative approaches and a variety of case-law, on the basis of increasingly widespread market practice. However, the reform, especially because of its particular legislative path that has led to a “split” between agri-food and craft products, raises numerous applicative and systematic doubts, also in terms of normative compatibility with current Italian legislation, which this contribution aims to analyze, offering possible corrective solutions.
