Equality bodies in attesa di riordino

Pending the approval of the relevant EU directives, the contribution discusses the reorganization of equality bodies in Italy. It recalls, in particular, the absence of a national human rights body implementing the so-called United Nations' 1991 Paris Principles and the simultaneous multiplication of different human rights and/or anti-discrimination bodies, including the more recent «Garante per i diritti delle persone disabili». The 2021 legislature intervenes with new tools (the gender certification of companies), reshapes existing tools (the report on the company workforce), changes the very notion of discrimination (Art. 25, paragraph 2-bis, Legislative Decree 198/06, in an improvised and technically wrong way), but does not address the issue of the effectiveness of existing equality bodies on sex or gender, which remain operational in labor matters with the same set-up as l. 125/91.
