The contribution aims to examine how the Covid-19 pandemic has tested the resilience of liberal-democratic orders. In this analysis, the author proposes a comparison between the contemporary era and the time at the beginning of the 20th century, pointing out the novelties proposed by the so-called 'soft-law' and the different approach to transparency with respect to health data, once assumed as an element to be 'hidden' and, today, as data to be 'disseminated'. On the paradigm of the 'transparency' of information, the contribution bases an analysis on the nature of 'political power' and the guarantees that the same power claims to impose on individuals.
