Les préambules dans le système conventionnel de la Charte sociale européenne : de la fonction interprétative à la fonction intégrative et « compensatoire »

In this essay, the text of the preambles to the international instruments forming part of the conventional system of the European Social Charter is first analysed in the light of the preparatory works available. The activity of the body that monitors the compliance and enforcement with these instruments by the States Parties, the European Committee of Social Rights (ECSR), is then examined. It perceived the preambles not as merely exhortative parts of their respective Treaties, which have only a moral and political effect, but as useful texts both to clarify the meaning and scope of the rights enshrined in their dispositive parts and to achieve the ambitious objectives that come out of their comprehensive protection system. In conclusion, the European Social Charter, also thanks to the legal effectiveness accorded by the ECSR to those parts of the preambles highlighted here, can rightly be referred to as the European legal instrument most capable of protecting the social rights of citizens of the States that have ratified and actually implemented it.

In questo saggio viene anzitutto analizzato il testo dei preamboli degli strumenti pattizi che fanno parte del sistema convenzionale della Carta sociale europea, alla luce dei lavori preparatori disponibili. Viene poi esaminata l’attività dell’organo che esercita il controllo sull’applicazione e il rispetto degli strumenti in parola ad opera degli Stati Parti, il Comitato europeo dei diritti sociali (CEDS). Esso ha percepito i preamboli non come delle semplici parti esortative dei rispettivi trattati, aventi effetti soltanto sul piano morale e politico, ma come dei testi utili sia a chiarire il significato e la portata dei diritti consacrati nei loro dispositivi, sia a raggiungere gli ambiziosi obiettivi che si evincono dal loro articolato sistema di protezione. In conclusione, la Carta sociale europea, grazie anche all’efficacia giuridica riconosciuta ad opera del CEDS a quelle parti dei preamboli evidenziate in questa sede, può a ragione venire indicata come lo strumento normativo europeo maggiormente in grado di proteggere i diritti sociali dei cittadini appartenenti agli Stati che l’hanno ratificata ed effettivamente applicata.
