Commons have existed in the Aosta Valley’s territory for centuries, of which the most distinguishing and still lively are called “Consorterie”. This article aims to study this peculiar form of commons, as well as the evolution of their legal status, focusing on national and regional legislation. This paper also seeks to analyse a regional draft bill on commons written by a technical group appointed by the regional government. Its principal goal is to provide Consorterie with a new legal status in line with the results achieved by scholars, jurisprudence and national legislation. Moreover, the legislative proposal explores the regional legislative competence related thereto by proposing some innovative solutions.

Abstract

La Région autonome de la Vallée d’Aoste témoigne d’une tradition séculaire en matière de propriétés collectives, dont la manifestation la plus originale et toujours active est représentée par les ‘consorteries’. Ce texte propose une étude de cette entité organisationnelle et propriétaire, ainsi que de son statut juridique suite aux retournements législatifs nationaux et régionaux. L’analyse se concentre sur le projet de loi régionale récemment élaboré au sujet des domaines collectifs régionaux qui vise à modifier la nature publique de ces entités, compte tenu de l’évolution des approches de la doctrine et de la jurisprudence en la matière ainsi que des principes de la loi nationale n. 168 du 20 novembre 2017. L’examen de ce projet et de ses solutions innovantes permet de mettre à l’épreuve les marges réelles de la compétence législative reconnue à la Région autonome.
