If only to preserve the effectiveness of the “nomophilacy” function of the Court of Cassation, the author hopes that the Italian legal system will retain a notion of international public order more evolved compared to those previously accepted, but still with a significant defensive potential of the most important features of the national legislation, such as in the case of the 2017 judgement of the United Sections on punitive damages and of the 2019 judgement again of the United Sections on surrogate motherhood.

Abstract
