In the light of the comparison between Rome and Athens, as suggested by Professor Remo Martini, the contribution will deepen the relationship, relevant on the structural and functional level, between the figure of the ἔφεσις to the popular court and the provocatio to the people, so as to draw both the most striking differences and the most interesting points of contact - and not the historical one of possible influences of the Athenian πολιτεία on the proto-republican constitution of Rome -.
