Cesare Beccaria interprets the malaise of his contemporaries in the face of the complex social and juridical dynamics that, over the centuries, take place around the theme/crime of the maternal infanticide. The invoked preventive action by the legislator to limit the infanticides committed to defend women’s honour, is measured with the traditional and still authoritative approach of modern criminalists, in order to gather the historical roots and, with them, the profound community reasons (still extraordinarily current) of the most ancient and atrocious of the crimes.

Abstract

Cesare Beccaria interprets the malaise of his contemporaries in the face of the complex social and juridical dynamics that, over the centuries, take place around the theme/crime of the maternal infanticide. The invoked preventive action by the legislator to limit the infanticides committed to defend women’s honour, is measured with the traditional and still authoritative approach of modern criminalists, in order to gather the historical roots and, with them, the profound community reasons (still extraordinarily current) of the most ancient and atrocious of the crimes.
