La autora trata la cuestión del trabajo irregular (desarrollado por los extranjeros) centrándose en las reglas domésticas en esta área, pero sin olvidar que –después de la adopción del Tratado de Lisboa– vivimos un período de estricta implementación del derecho de la Unión Europea. Las reflexiones legales son acom- pañadas por constantes referencias a la literatura académica que crecientemente se ha ido publicando en esta área y la que se ha expandido considerablemente en los años recientes (con diferentes características en los nuevos y antiguos países de inmigración). Después de exponer las características compartidas entre los distintos países del área mediterránea y destacando la existencia de una gobernanza multinivel, el estudio se centra en la Directiva 2009/52. Esta Directiva ofrece un marco de observación de las más importantes cuestiones legales relacionadas con el trabajo irregular (desarrollados por extranjeros). Esto incluye en particular: a) la cuestión relacionada con el conpceto de trabaja- dor irregular extranjero; b) las varias sanciones aplicables en Italia (para ambos, empleadores y trabajadores); c) la cuestión de los trabajadores a quienes sobreviene el estado de irregular; d) cuestiones relacionadas con el acceso a la justicia de los trabajadores irregulares extranjeros (especialmente si son víctimas de serias explota- ciones) y finalmente, e) la explotación de los trabajadores autónomos, una situación que es difícil punir y cuya relevancia no se limita solo a los trabajadores migrantes. AbstRAct: The author deals with the issue of undocumented work (by foreign natio- nals) focusing specifically on the domestic rules in this area, but without forgetting that –after the adoption of the Lisbon Treaty– we are living in a period of strict implementation of EU law. The legal reflections are accompanied by a constant reference to the academic literature which is increasingly being published in this area and which has expanded considerably in recent years (with different charac- teristics within the new and traditional immigration countries). After setting out the characteristics shared between the various countries from the Mediterranean area and noting the existing multi-level governance, the paper will focus on Directive 2009/52. This Directive offers a framework for viewing the most important legal questions raised by undocumented work (by foreign nationals). This includes in particular: a) the question regarding the concept of an undocu- mented foreign worker; b) the various sanctions applicable in Italy (for both emplo- yers and employees); c) the issue of a worker’s supervening undocumented status; d) questions related to access to justice by undocumented foreign workers (especially if a victim of serious exploitation) and finally e) the exploitation of self-employed labour, a situation which is difficult to punish, and the relevance of which is not limited solely to migrant workers.
