The essay retraces the theme of the state as an “insurance mechanism”, highlighting how today this system can be recognized in the common request for legal certainty and even more in the principle of entrusting (affidability). To overcome this crisis the Author proposes to recover the paradigm of “prudentia iuris” through the daily activity of the judges.
