Starting from some considerations about the current ‘fortune’ of normative law in the ‘civil law’ legal systems, the Author retrieves some paradigms of juridical science and technique to highlight the potential absolutist drifts of the primacy of the law. What emerges is a re-evaluation of the role of the prudentia iuris, facilitated by the analysis of the recent contribution of one of the most authoritative living italian jurists, Paolo Grossi, who has spent a lot of effort denouncing how the law lives more in human experience than in written laws.

Abstract
