The area of studies on “Law & literature” or better, “Law & Humanities”, shows a fundamental analogy between law and artistic and literary manifestations: the ability to focus on the multiplicity of the aspects of social life in which man finds himself acting, in history. The law aims to dictate orders on behaviours to observe or to avoid, by means of rewards and prohibitions, while literature and art seek to understand and portray the essence of those behaviours: in both cases, they start (or should start) with a faithful representation of reality and its understanding. Here law and art have the same aim: man in social life. Therefore, they can be compared, because they give different, but not opposing points of view, which can usefully fit into the same reality.

Il filone di studi su «Law & literature» o, meglio, «Law & Humanities», evidenzia una fondamentale analogia tra il diritto e le manifestazioni artistiche e letterarie: la capacità di mettere a fuoco la molteplicità degli aspetti della vita sociale nella quale l’uomo si trova ad agire, nella storia. Il diritto vuole dettare prescrizioni sui comportamenti da tenere o da evitare, attraverso premi e divieti, mentre la letteratura e l’arte cercano di capire e raffigurare l’essenza di quegli stessi comportamenti: in entrambi i casi si parte (o si dovrebbe partire dalla fedele rappresentazione della realtà e dalla sua comprensione. Per questo diritto e arte hanno lo stesso oggetto: l’uomo nella vita di relazione e per questo possono essere paragonati, perché offrono punti di vista diversi ma non opposti e utilmente integrabili della stessa realtà.
