The financial crowdfunding, as an alternative source of financing, has been an important phenomenon in EU Countries in the last years. Nevertheless, the juridical framework of this instrument is not so clear, since just a few EU Countries provided for specific rules about it. The chapter analyzes crowdfunding-specific legislations (showing the different approaches followed by some of the main European Countries), the impact on financial crowdfunding of national financial regulations (when specific rules do not exist) and some proposals of rules that could constitute an adequate common framework. Such proposals will take in account the two main pillar of the subject (the need of facilitate financing for start-up businesses and the need of protect investors), looking for the most effective balance between them.

Abstract
The financial crowdfunding, as an alternative source of financing, has been an important phenomenon in EU Countries in the last years. Nevertheless, the juridical framework of this instrument is not so clear, since just a few EU Countries provided for specific rules about it. The chapter analyzes crowdfunding-specific legislations (showing the different approaches followed by some of the main European Countries), the impact on financial crowdfunding of national financial regulations (when specific rules do not exist) and some proposals of rules that could constitute an adequate common framework. Such proposals will take in account the two main pillar of the subject (the need of facilitate financing for start-up businesses and the need of protect investors), looking for the most effective balance between them.I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
