Il contratto di transazione ha sempre suscitato un certo interesse negli studiosi dei diversi periodi storici, i quali ne hanno affrontato prevalentemente alcuni profili, ovvero: la natura costitutiva o dichiarativa, la ”res dubia” e le reciproche concessioni ed il concetto di “caput controversum”. Con questa ricerca si intende approfondire il tema della transazione conclusa su un contratto illecito e su un titolo nullo. Si tratta di un tema di particolare interesse, in quanto investe il dogma di origine romana dell’intangibilità del contratto di transazione, che è necessario rivisitare alle luce della nuova prospettiva tracciata dal diritto privato europeo. In altri termini, alla transazione non è più possibile attribuire l’efficacia della sentenza passata in giudicato. Viceversa, al pari di un qualsiasi altro contratto, essa produce effetti tra le parti. In questa nuova prospettiva deve leggersi l’art. 1472 c.c., che deve costituire lo strumento per consentire ai contraenti di far cadere quel velo di intangibilità caduto con la transazione sull’accordo raggiunto dai contraenti.
