The essay offers a few philosophical coordinates for rethinking criminal justice in a restorative way. If restorative justice offers a new paradigm of criminal justice, thereby proposing its global rethinking into a more "civilised" approach to punishment, this coureageous approach still appears to be weak in sustaining its proposal through sound ethical and philosohical standponts. The essay suggests that such standpoints could be found within a so-called "dialogical approach", that the author outlined in contact with the classical legal-philosophical heritage.
