Despite the European Union's (EU) extensive network of regulatory sources on the subject, the principle of equal pay for men and women still proves ineffective in terms of implementation and enforceability in the courts. The new EU Directive no. 2023/970 addresses this problem by tackling the lack of pay transparency and clarity on the concept of work of equal value, which is crucial for applying the principle in contexts of horizontal segregation. The chapter analyses these two lines of action, assessing their interaction with Directive no. 2022/2041 on adequate minimum wages in the EU.

Abstract

Despite the European Union's (EU) extensive network of regulatory sources on the subject, the principle of equal pay for men and women still proves ineffective in terms of implementation and enforceability in the courts. The new EU Directive no. 2023/970 addresses this problem by tackling the lack of pay transparency and clarity on the concept of work of equal value, which is crucial for applying the principle in contexts of horizontal segregation. The chapter analyses these two lines of action, assessing their interaction with Directive no. 2022/2041 on adequate minimum wages in the EU.
