“Ius e ars” o “ius è ars”. Il diritto come “arte” nelle fonti romanistiche

The essay analyses the relationship between law and art in light of the evidence handed down by the jurists of ancient Rome. After introducing the topic through some reflections regarding the polysemy of the term ars, the essay dwells on two different readings of law as art: on the one hand, as a systematic and scientific construction of law, as an architecture capable of ordering the normative landscape; on the other hand, as ars boni et aequi, as the ability to identify the most suitable solution with respect to the concrete case and in accordance with the aims of iustitia. In this sense, one can speak of the jurist as an artifex and of law as a true ars.

Il saggio analizza il rapporto tra diritto e arte alla luce delle testimonianze tramandate dai giuristi di Roma antica. Dopo aver introdotto il tema attraverso alcune riflessioni in ordine alla polisemia del termine ars, il saggio si sofferma su due diverse letture del diritto come arte: da un lato, come costruzione sistematica e scientifica del diritto, quale architettura in grado di ordinare il panorama normativo; dall’altro, come ars boni et aequi, quale capacità di individuare la soluzione maggiormente idonea rispetto al caso concreto e conforme alle finalità di iustitia. In tal senso si può parlare del giurista come di un artifex e del diritto come di una vera e propria ars.
