This essay is intended to show the moral and juridical implications of Hegel’s understanding of mental derangement: starting from Hegel, I will then focus in particular on some fruitful thoughts of the jurists Albert Friedrich Berner and Christian Reinhold Köstlin, who introduced and developed Hegel’s categories in the German law and who are known, for this reason, as the “Hegelian” jurists of the 19th century.
