The Geneva Convention on the International Carriage of Goods by Road is a fundamental text of uniform law. It has played a substantive role in fostering economic exchange and consequently social development in Europe and a part of Asia, such as Turkey, which sits beyond the furthest edges of the European Union,In the last few decades at least, the main works published in English, and hence those that have enjoyed the most widespread reach, have relied on the ideas of authoritative common law academics. These definitely provide a reference framework for all. There are also some extremely complex and systemically important works penned in German, French, Spanish, and Italian, providing more of a view of people versed in continental law. This project is inspired by the wish to make a contribution in this field, retaining the same continental cultural framework but using the language most widely adopted in Europe (and beyond), in the hope of facilitating comparison between experiences in continental systems and those of common law. Despite the enormous theoretical efforts of the authors, the interpretations between the two sides do differ frequently and it might well be necessary to engage in further discussion and debate to refine the final analysis and improve the comparison of ideas. The Convention itself is based largely, if not entirely, on the traditional theories of civil law systems, with a very significant contribution being made by case law and precedent in these countries.
