Starting from the perspective of European Private Law, the thesis provides a historical-comparative survey of the evolution and circulation of legal models concerning testamentary freedom, the protection of the deceased's closest family members by forced heirship, and the efficient organisation of the generational transfer of productive assets. The research aims to ascertain how the interests underlying the relevant legal instruments have been valued and balanced in the different historical and territorial contexts, examining the role of the various legal formants, as well as reviewing the economic, social, religious and cultural factors and the episodes of legal transplant that have influenced the evolution of the subject in the systems considered, and finally identifying the current reformist trends, which may pave the way towards the convergence of national experiences. The thesis thus presents a diachronic and synchronic comparative analysis between Italy, France, Germany, and England, in relation to the regulation of the forced heirship and the main estate planning institutions with regard to productive assets (with a focus on individual enterprises), including agreements on succession, anticipatory succession, and trusts. The survey is completed by examining the existing supranational rules of uniform private international law, their impact on transnational succession practices, and their ultimate role in transforming national substantive law.
Muovendo dalla prospettiva del diritto privato europeo, la tesi propone un’indagine storico-comparatistica dei processi evolutivi e dei fenomeni di circolazione dei modelli giuridici ricorrenti in materia di libertà testamentaria, di tutela dei più stretti congiunti del de cuius nella successione necessaria e di efficiente organizzazione del passaggio generazionale dei beni produttivi. La ricerca intende verificare come gli interessi sottesi ai vari strumenti giuridici rilevanti siano stati valorizzati e bilanciati nei differenti contesti storici e territoriali, procedendo ad esaminare il ruolo dei diversi formanti giuridici, nonché ad individuare i fattori economici, sociali, religiosi e culturali e gli episodi di legal transplant che hanno influenzato l’evoluzione della materia negli ordinamenti considerati, identificando infine le attuali tendenze riformistiche e le possibilità di convergenza delle esperienze nazionali. La tesi procede quindi ad un’analisi comparatistica diacronica e sincronica tra Italia, Francia, Germania ed Inghilterra, relativamente alla disciplina delle tutele dei legittimari e dei principali istituti di pianificazione della successione nei beni produttivi, e segnatamente nell’impresa individuale, tra patti successori, istituti di successione anticipata e trusts. L’indagine viene completata dall’esame delle normative sovranazionali di diritto internazionale privato uniforme esistenti in materia, del relativo impatto sulle pratiche successorie transnazionali e, in definitiva, del ruolo da esse esercitato sulla trasformazione dei diritti sostanziali nazionali.
