This paper analyzes some recent judgments rendered by the Constitutional Council on the constitutional legitimacy of the French law regarding immigration and the socalled crimes of solidarity – délit de solidarité or délit d’hospitalité –; also, in light of the fraternity principle, focusing on the limits of asylum right and French legislation on immigration and illegal entry and stay of non-nationals in France.
