Another brick in the wall? Il difficile dialogo costituzionale con l'immagine del Cristo crocifisso.

On both side of Atlantic, Courts and Parliaments often face the tricky matter related to the public exposition of religious symbol, which represents a real challenge for constitutionalism. Usually, legal reasoning tries to face this issue answering to some crucial questions concerning the single case: Where is the symbol situated? Does the symbol have some meaning which trascends its original religious connotation? What is the real aim of public authorities placing that symbol? With regards to crucifix, this article attempts a different approach: Christianity, because of its essence, has a particular relation both with the sacred dimension and the role of images. In some ways this religion escapes from the sacred and, in doing so, it rationalizes the divinity giving it a specific face – that of Jesus Christ. This has important consequences on the constitutional level, because it must be asked whether a balance of interests is possible with an image which incarnates God through the highest degree of definition, namely that of a man in the flesh.

Il nodo costituzionale dell’esposizione pubblica di simboli religiosi è ben noto su entrambe le sponde dell’Atlantico, posta la frequenza con la quale Corti e Parlamenti si trovano ad affrontare il tema. Di norma, il ragionamento giuridico si concentra su peculiari aspetti del singolo caso: il luogo in cui il simbolo è situato, la capacità del suo significato di trascendere l’originaria connotazione meramente religiosa, il vero obiettivo perseguito delle autorità pubbliche nel disporne l’esposizione. Con riferimento al crocifisso, si tenta qui un approccio diverso. Il Cristianesimo, strutturalmente, intrattiene un particolare rapporto sia con la dimensione del sacro, sia con il ruolo delle immagini. In un certo senso, esso sembra fuggire dalla sacralità, cosi giungengo a razionalizzare la divinità ed a confererirle una fisionomia precisa: quella di Gesù Cristo. Ciò può avere delle conseguenze importanti sul piano costituzionale, posto che pare opportuno chiedersi se il bilanciamento di interessi sia possibile innanzi ad un immagine che incarna la divinità attraverso il più alto grado di definizione possibile: quello di un uomo in carne ed ossa.
