The article reflects on the role of law and legal research on the health and health and safety of migrant workers according to an interdisciplinary logic. It uses the approach of the social determinants of health to highlight the effects of law, and in particular of immigration law, as a creative source of health inequalities, and makes the case for a labour based approach for enhancing the health and health and safety of migrant workers, arguing that claims towards States in this direction might find support with the international framework on the protection of the fundamental right to health.

Le riflessioni contenute nel presente contributo sono collegate al progetto Vivere e lavorare in salute e sicurezza: prospettive di cambiamento per i lavoratori migranti nel settore agro-zootecnico – LivingStone ID 45/2016, finanziato nell’ambito del bando BRIC 2016 Inail. Gli esiti della ricerca sono pubblicati in Lavoro insicuro (2020). La ricerca ha offerto l’opportunità di un confronto interdisciplinare prezioso su migrazioni, lavoro e salute. Questo confronto, pur coinvolgendo anche le scienze sociali, ha meritato di essere percorso soprattutto con riguardo al dialogo inusuale tra diritto, studi sulla salute, e medicina. Le riflessioni offerte sono state elaborate e discusse in tre occasioni pubbliche: 4-7 settembre 2018, XXII Conferenza mondiale della Società Internazionale di Diritto del Lavoro e della Sicurezza Sociale, Transformations of Work: Challenges for the National Systems of Labour Law and Social Security, Torino; 23-25 giugno 2019, LLRN 4 Valparaíso, Labour Law Research Network Conference, Valparaíso; 2 settembre 2019, Work, Migrations and Health, Università di Padova. Una prima versione in lingua inglese del contributo è contenuta in Developing an Interdisciplinary Approach to the Health and Safety of Migrant Workers, in Promoting the Health and Safety of Migrant Workers.
