The contract of «subtrasporto» has been regulated by the «decreto legislativo » 286/2005, as modified by the law n. 190/2014. The regulation has had a great impact, as the previous regulation was much simpler in its features than the present one. In fact, a carrier could draw up more than one «subtrasporto», and he did not have to respect formal requisites, provided for the enforceability of the contract. Now, the consigner has to give his consent if the carrier wants to draw up a «subtrasporto». Moreover, it is possible to enter into it only once. The breach of the rule implies the nullity of the act.
