Abstract

In the present structure of information and Internet society we cannot think to face the challenges posed by the new technologies, when they are used for the commission of serious crimes (such as terrorism), with the traditional means of investigations only. We must take into account the need for a wide and varied discussion on the adoption of new tools evoking the absoluteness of fundamental rights. This work is focused on the limits within which the legislator (national and European) can operate in the impairment of fundamental rights and in the fight against terrorism and cybercrime
