The South African Constitutional Court plays an active role in addressing the issues concerning land and housing rights. The article discusses the Daniels and Raube cases where the Supreme Court partially departed from traditional legal method by providing an extensive contextualisation of the land claims. In particular, it is argued that judges showed awareness of the legal construction of spaces during the colonial and apartheid regimes and integrate this narrative in their judgments.

Abstract
