The object of this comment revolves around the antitrust liability of the State as legislator, in light of the principle of effet utile in European Union competition law. In particular, the case of Italian legislation imposing minimum costs for transport services offers the chance for the Court of Justice to apply stable principles from its case-law: on the one hand, in relation to the subjective scope, it is confirmed that the State violates its duty of sincere cooperation only if the anticompetitive regulation is connected to an unlawful private agreement; on the other hand, in relation to the possible justification for reasons of public interest, it is reaffirmed that such an exception can be satisfied only if the restriction so imposed respects the fundamental principles of necessity and proportionality. After having reported the outcome of the decision, in fact totally agreeable, this comment focuses on the critical issues that still affect the argumentative structure of the legal reasoning followed by the Court of Justice: namely, enduring theoretical inconsistencies are highlighted, which render still incomplete this control system with respect to the objective of effective protection of competition, especially in the delicate field of legislative price-fixing by Member States.

Il tema del presente commento ruota attorno alla responsabilità antitrust dello Stato, nella sua veste di legislatore, alla luce del principio dell’effetto utile del diritto della concorrenza nell’Unione europea. In particolare, il caso della legislazione italiana sui costi minimi obbligatori per i servizi di autotrasporto offre l’occasione alla Corte di giustizia per applicare principi consolidati della propria giurisprudenza: da un lato, sul piano della portata soggettiva, si conferma che la violazione dell’obbligo di leale cooperazione da parte dello Stato sussiste solo a condizione che la normativa anticoncorrenziale sia connessa ad un’intesa imprenditoriale illecita; dall’altro lato, sul piano della possibile giustificazione per ragioni di interesse pubblico, si ribadisce che tale eccezione può valere solo se la restrizione così imposta rispetta i fondamentali principi di necessità e proporzionalità. Dato conto dell’esito della decisione, pur pienamente condivisibile, il presente commento focalizza l’attenzione sui profili critici che permangono nella struttura argomentativa del ragionamento giuridico seguito dalla Corte di giustizia: segnatamente, si evidenziano persistenti incoerenze teoriche, che rendono ancora incompleto tale sistema di controllo rispetto all’obiettivo di un’effettiva tutela della concorrenza, soprattutto nella delicata materia della fissazione normativa dei prezzi da parte degli Stati membri.
